Appeal by the defendant from a judgment of the County Court, Suffolk County (Vaughn, J.), rendered November 15, 1983, convicting him of robbery in the first degree, robbery in the second degree (two counts), assault in the second degree (two counts), and grand larceny in the third degree, upon a jury verdict, and imposing sentence. Judgment modified, on the law, by reversing the conviction of assault in the second degree as charged in the fifth count of the indictment and the sentence imposed thereon, and dismissing that count. As so modified, judgment affirmed.
